What this site does — and what it doesn’t
We publish plain-English guides to North Carolina law as it applies to Pender County residents — the statutes, court procedures, deadlines, and what to realistically expect. What we don’t do is practice law. We’re not a firm, we don’t employ attorneys, and nothing here is legal advice for your case.
What we can do is connect you with attorneys who handle cases at the courthouse in Burgaw and know how the local courts work. That connection is free, and the initial consultation usually is too.
Practice areas we cover
Criminal defense
North Carolina classifies felonies from Class A through Class I under N.C.G.S. § 15A-1340.17, with sentencing that depends on the offense class and your prior record level. Misdemeanors run from Class A1 down to Class 3. If you’ve been charged in Pender County Superior or District Court — at the courthouse on S. Wright Street in Burgaw — timing matters from the first court date forward. Read the criminal defense guide, or call (910) 407-0749.
DWI & traffic
North Carolina sentences DWI on six levels under N.C.G.S. § 20-179, from Aggravated Level One (carrying up to 36 months) down to Level Five. The legal limit is 0.08% BAC for drivers 21 and over, 0.04% for commercial drivers, and zero tolerance under 21 (§ 20-138.3) — and a charge can still be based on observable impairment at a lower BAC. A first DWI conviction generally means a one-year license revocation under § 20-17. See the full DWI and traffic guide.
Personal injury
North Carolina is one of only a few states — along with Alabama, Maryland, Virginia, and the District of Columbia — that still follows pure contributory negligence, where being even one percent at fault can defeat the entire claim. The deadline to file most injury lawsuits is three years from the date of injury under N.C.G.S. § 1-52. This is not a rule to learn about after the deadline has passed. Learn more about personal injury claims in Pender County.
Workers’ compensation
Workplace injuries go through the NC Industrial Commission, not the regular civil courts. You generally must notify your employer in writing within 30 days (§ 97-22) and file a formal claim on Form 18 within two years of the injury (§ 97-24). Missing the filing deadline typically means losing the claim entirely. Read the workers’ comp guide for Pender County employees.
Family law
North Carolina requires one year of continuous separation, in separate residences, before you can file for absolute divorce under N.C.G.S. § 50-6. Custody is decided under the best-interests-of-the-child standard (§ 50-13.2), and child support follows the NC Child Support Guidelines based on combined parental income (§ 50-13.4). See the family law guide.

Every Pender County case turns on its own facts. A free 15-minute attorney consultation costs nothing and tells you what you’re really looking at.
Why local representation matters in Pender County
Pender County is part of Prosecutorial District 6, which also includes New Hanover County, and sits in Superior Court District 6 and District Court District 6. The Superior Court and District Court both meet at 100 S. Wright Street in Burgaw. Attorneys who practice here regularly know the local judges, the prosecutors, and how the Pender County Clerk of Superior Court’s office operates.
That’s not a small thing. Court procedures and prosecutorial tendencies vary meaningfully between North Carolina counties. An attorney who handles cases regularly in Pender County District Court is working in a different environment than one who mostly practices in Wilmington. Local knowledge is part of what you’re paying for.

Frequently asked questions
Is Pender County Legal Resource Center a law firm?
No. This site is a legal information and referral resource operated by Wilder West Assets LLC, not a law firm. We publish guides to North Carolina law and connect Pender County residents with licensed NC attorneys. Nothing here is legal advice for your situation — an attorney consultation is the only way to get advice for your specific case.
How much does an attorney consultation cost?
Most criminal defense, personal injury, DWI, and workers’ comp attorneys offer a free initial consultation. Family law attorneys sometimes charge a flat fee for the first meeting; it varies by attorney. Connecting through this site is always free.
Where is the Pender County courthouse?
Pender County Superior Court and District Court are both at 100 S. Wright Street, Burgaw, NC 28425. Pender County is in Prosecutorial District 6 and Superior/District Court District 6, which it shares with New Hanover County.
What’s the deadline to file a personal injury lawsuit in North Carolina?
Most personal injury claims must be filed within three years of the injury under N.C.G.S. § 1-52. Some cases — medical malpractice, claims against government entities, and wrongful death — have different deadlines or shorter notice requirements. Missing a deadline typically ends your right to sue.
Can I be convicted of DWI in North Carolina under 0.08% BAC?
Yes. A BAC of 0.08% or above is a per-se violation under N.C.G.S. § 20-138.1, but a prosecutor can also charge impaired driving based on observable signs of impairment at any BAC. Drivers under 21 face zero tolerance under § 20-138.3, and commercial drivers have a 0.04% limit.
What happens if my employer disputes my workers’ comp claim?
Disputed claims go before the NC Industrial Commission, which administers the system under N.C.G.S. § 97-1 and following, through a hearing before a Deputy Commissioner, with appeals to the Full Commission and then the NC Court of Appeals. You still have two years from the date of injury to file your claim on Form 18 under § 97-24.
Do I have to go to court for a traffic ticket in Pender County?
Not always. A traffic attorney can often appear in Pender County District Court on your behalf without you being present, depending on the charge. Minor infractions can sometimes be resolved with a prayer for judgment continued (PJC) or by paying the fine, but those options affect your insurance and record differently.
